If i enter a business deal and he has no pre nup can he lose control of his part of the business?

i want to form a new llc and give my business partner 50% but he doesn't have a pre nup and I dont want him to lose it to his wife so i may not enter into this partnership with him as I don't want to work with his wife on this company
